1. Data Controller

The controller of your personal data provided via the website (including the 3D calculator and forms) is D&M Design and Measurements Michał Bieniek based in Poland, VAT ID (NIP): 6292279531, REGON: 384106560 (hereinafter: "Controller" or "Addytywni3D").

2. Purpose and Legal Basis of Processing

We process your data (such as: name, surname, e-mail address, phone number, delivery address, company details) and uploaded files (e.g., STL, STEP) exclusively for the following purposes:

• Providing an offer and quotation: Based on the uploaded 3D files and parameters, we prepare a binding production offer (legal basis: taking steps at the request of the data subject prior to entering into a contract - Art. 6(1)(b) GDPR).
• Order fulfillment: Printing, post-processing, packaging, and delivery of parts to the specified address.
• Accounting and tax purposes: Issuing VAT invoices (Art. 6(1)(c) GDPR).
• Ongoing communication: Handling inquiries and maintaining contact via email tools (Gmail) or the WhatsApp messenger (our legitimate interest - Art. 6(1)(f) GDPR).
• Marketing and advertising: Running campaigns and remarketing activities through tools such as Google Ads (legal basis: your explicit consent - Art. 6(1)(a) GDPR).
• Analytical purposes and quality improvement: Analyzing anonymous statistics of abandonments and errors in the quotation form to improve the platform's operation (our legitimate interest - Art. 6(1)(f) GDPR).
• Establishing and defending against claims: In the event of potential disputes regarding order fulfillment (Art. 6(1)(f) GDPR).

3. Intellectual Property Protection (NDA)

As engineering specialists, we understand the importance of protecting know-how. All 3D files, technical drawings, and photos uploaded by you are treated as strictly confidential. We use them solely to provide a quote and for potential production. We do not share them with third parties without your explicit consent, we do not use them for our portfolio (unless we obtain separate permission), and we permanently delete them upon your explicit request after the order is completed.

4. Recipients of Personal Data

To ensure efficient service delivery, your data may be transferred exclusively to trusted processors acting on our behalf:

• Courier and logistics companies (for parcel delivery).
• Hosting service provider (Seohost).
• Providers of cloud, office, and AI tools (Google Workspace: Gmail, Google Drive, Google Gemini).
• Providers of messaging, project management, and automation systems (WhatsApp, ClickUp, Make.com).
• Accounting office (for accounting purposes, in the case of issuing an invoice).

Due to the use of global providers (such as Google, Meta/WhatsApp, ClickUp, or Make.com), some of your data may be transferred outside the European Economic Area (e.g., to the USA). This transfer is based on legal grounds regulated by EU law, including the European Commission's adequacy decision (Data Privacy Framework) or standard contractual clauses.

5. Data Retention Period

We will process your data only for as long as necessary:

• Quotation requests: Data from unfulfilled quotes (including uploaded 3D models) is regularly deleted, usually within 30 days after the offer's validity expires.
• Completed orders: We store data for the period required by tax and accounting laws (5 years from the end of the calendar year in which the invoice was issued).
• 3D models from orders: We store them in a secure archive (including Google Drive) solely to facilitate potential reprints in the future. At your explicit request (e.g., invoking an NDA), we will delete them immediately after shipping the package.

6. Cookies, Analytics, and Ads

Our website uses cookies and browser memory technology (e.g., SessionStorage) for the proper functioning of the 3D calculator and to remember the progress of part configuration (these are so-called essential cookies). This serves to optimize our business tools.

EU and German Legal Requirements (incl. TDDDG): We respect your privacy. Additional cookies used for marketing purposes and advanced analytics provided by external services (Google Analytics, Google Ads) collect information about traffic on our website. In accordance with EU and local privacy regulations, these scripts are activated only after you express your explicit consent in our cookie banner. You can withdraw or adjust your consent at any time from your browser settings or the preference management tab on our website.

Automated quotations: The cost of 3D printing is calculated by an algorithm (3D Calculator) based on the uploaded geometry and selected materials. However, this does not constitute automated decision-making producing legal effects concerning you (within the meaning of Art. 22 GDPR) – it only serves to quickly present an estimated offer.

7. What are your rights (GDPR)?

Under the regulations, you have the right at any time to:

• Access your data and receive a copy of it.
• Rectify (correct) your data.
• Delete your data (the right to be forgotten), unless its processing is required by separate legal provisions (e.g., invoice retention).
• Restrict processing and data portability.
• Withdraw your consent at any time (if processing is based on it - e.g., advertising cookies).
• Object to data processing based on our legitimate interest (e.g., regarding statistical analytics).
• Lodge a complaint with the supervisory authority (President of the Personal Data Protection Office in Poland).
